1. Preamble
Welcome to Takidaki — available at https://takidaki.com (“Website”) and as an iOS mobile application on the App Store (“App”). Together, these are referred to as the “Platform”.
These Terms of Use (“Agreement”, “Terms”) are a legal agreement between you and Kivaro Tech OÜ (registered in Estonia, Harju maakond, Tallinn, Kristiine linnaosa, Kotkapoja tn 2a-10, 10615). By accessing the Website or downloading and using the App, you agree to be bound by these Terms.
This Agreement incorporates our Privacy Policy and Refund Policy (collectively, the “Policies”). We may update these Terms at any time. Your continued use of the Platform after any changes signifies your acceptance of the updated Terms.
Apple notice: These Terms are an agreement between you and Kivaro Tech OÜ only — not with Apple Inc. Apple is not responsible for the App or its content.
2. Regulatory Status
Takidaki operates as a digital platform providing promotional tools and random draw services. We comply with all applicable laws, including the GDPR, Apple App Store Guidelines, and Meta Platform Policy (where applicable).
3. Eligibility
3.1. The Platform is intended for users aged 18 and older. By using the Platform, you confirm you meet this requirement.
3.2. Users in the EU must be at least 16 years old to consent to data processing independently.
3.3. You are solely responsible for ensuring your use of the Platform complies with all laws applicable in your jurisdiction.
4. Access and Use
4.1. The Platform allows users (“Organizers”) to conduct giveaways and contests by selecting winners using a randomization mechanism, and to use additional tools (coin flip, dice roll, number randomizer, team splitter, list randomizer, yes/no picker).
4.2. Organizers are responsible for defining the terms of their own giveaways, including prize delivery and participant eligibility.

5.1. To access full features of the App, you must register an account using Apple Sign In, Google Sign In, or email.
5.2. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
5.3. You must provide accurate information. We reserve the right to suspend accounts with false or misleading information.
6. Subscriptions and In-App Purchases
6.1. Takidaki offers subscription plans with access to premium features (“Pro” or equivalent). Pricing is displayed within the App and on the Website.
6.2. All In-App Purchases are processed exclusively through Apple’s App Store payment system. We do not collect or store your payment card information.
6.3. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
6.4. You can manage and cancel subscriptions at any time via: iOS Settings → Apple ID → Subscriptions → Takidaki.
6.5. Refunds for App Store purchases are handled by Apple in accordance with their refund policy. You can request a refund at https://reportaproblem.apple.com.
6.6. For purchases made via the Website (if applicable), refund requests must follow our separate Refund Policy.
7. Provision of Services
7.1. Takidaki is a tool provider, not a giveaway organizer. Organizers are solely responsible for the execution, terms, and compliance of their giveaways.
7.2. We offer randomization tools to help Organizers select winners fairly and transparently.
7.3. We do not guarantee the outcome of any giveaway or the delivery of any prizes.
8. Winner Selection
8.1. Winners are selected from a participant list based on rules defined by the Organizer.
8.2. Participant data (usernames, entry numbers) is used exclusively for draw purposes and is not shared with third parties.
8.3. The randomization algorithm produces cryptographically fair results. However, we recommend Organizers independently verify results if required by local laws or contest rules.
9. Third-Party Services and Meta Integration
9.1. The App may connect to third-party platforms including Instagram and Facebook (via Meta API), Google, and Apple for authentication and data retrieval.
9.2. Your use of these integrations is subject to the respective platform’s terms:
9.3. We request only the minimum necessary permissions from Meta (public_profile, email). We do not access private messages, follower lists, or any data beyond what is needed for the service.
10. Intellectual Property
10.1. All content on the Platform — including text, logos, graphics, software, UI design, and animations — is the property of Kivaro Tech OÜ or its licensors and is protected by applicable intellectual property laws.
10.2. You may not copy, reproduce, or exploit any part of the Platform without prior written permission.
10.3. The App is licensed to you (not sold) under a limited, non-exclusive, non-transferable license solely for personal use on Apple-branded devices you own or control.
11. Apple-Specific Provisions
As required by Apple App Store Guidelines:
11.1. Maintenance and Support: Kivaro Tech OÜ is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide support.
11.2. Warranty: To the maximum extent permitted by applicable law, the App is provided “as is”. If the App fails to conform to any warranty, you may notify Apple for a refund of the purchase price. Apple has no other warranty obligations.
11.3. Product Liability: Kivaro Tech OÜ, not Apple, is responsible for any product liability claims, consumer protection claims, or regulatory claims relating to the App.
11.4. Intellectual Property Claims: Kivaro Tech OÜ, not Apple, is responsible for investigation, defense, settlement, and discharge of any third-party intellectual property infringement claims.
11.5. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Promotional Communications
By registering, you consent to receive service-related notifications (push notifications, emails). Promotional communications require explicit opt-in. You can opt out at any time via:

13.1. For complaints, contact us at info@takidaki.com. Please provide full details to help us assess your case.
13.2. We aim to respond within 10 business days.
13.3. If a dispute cannot be resolved directly, it shall be referred to the competent courts of Estonia under EU law.
14. Disclaimers and Limitation of Liability
14.1. The Platform is provided “as is” without warranties of any kind.
14.2. We do not guarantee uninterrupted availability, accuracy, or completeness of the Platform.
14.3. To the maximum extent permitted by law, Kivaro Tech OÜ’s total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.
14.4. We are not responsible for actions, omissions, or prize delivery by giveaway Organizers.
15. Termination
15.1. We may terminate or suspend your access to the Platform at any time, with or without notice, for violation of these Terms.
15.2. Upon termination, your right to use the App ceases immediately. You should delete the App from your device.
15.3. Sections 10, 11, 13, 14, and 16 survive termination.
16. Governing Law
These Terms are governed by the laws of Estonia and the European Union. Any disputes shall be resolved by the competent courts of Tallinn, Estonia.
